  7. Charges never give jurors “an out”. Each felony law is very specific as to what it is an how it applies. If a crime doesn’t fit the specific definition, then you cannot find someone guilty of it. The prosecutors simply don’t know where this might fit and when it comes back as manslaughter, which I think it will, the DA doesn’t want to be blamed for not giving a Murder 3 option.
