Did some digging and figured out she’s South Korean. A solution could be handing her over to their neighbors up north. I’m sure they’re quite accommodating and Chairman Kim could find good use for her
This stupid precedent started with Charles Manson and the Helter Skelter Murders. Manson NEVER killed anyone. He merely told someone to do something and those people took upon themselves to do it. This was a dangerous precedent to allow and now it's being used to essentially violate a person's right to say what they want. We may not like it or the person, but that doesn't mean that they should be charged and jailed because of what they said.
What ever happened to a person being responsible for their own actions.
The other case involving a girl sending text messages to her boyfriend urging him to kill himself. He does and she gets charged with manslaughter and is convicted and jailed.
What is manslaughter?
Homicide is any physical actions taken alone of in concert with others that has one human being cause the death of another human being. Manslaughter and Murder are both forms of homicide.
Murder is any physical action taken alone or in concert with others where the action(s) are planned/premeditated that results in the death of another human being. Also if you are in the middle of committing another crime and the person ends up dying, you can be charged with murder.
Manslaughter – is any physical action taken alone or in concert with others that ISN'T planned that results in the death of another human being.
Example: You and another person is fighting and you strike the person and they fall down and die.
You can't LAWFULLY be charged or made responsible for someone's death because you said something.
In the United States the constitution protects your ability to say whatever you want. There are some situations where restrictions are made, like yelling bomb on a plane or crowded room. Outside of something like that, you are lawfully protected in what you can say.
Because she TOLD him to kill himself, doesn't make it a crime. This is a direct attack on the first amendment which protects ANYONE'S right to say what they want in this country or any of its territories. It does this by placing the restriction on the government, that they are restricted from making law or taking any actions against someone (citizen or not) for merely saying something.
This is allowed because it is something people don't like and so they do nothing in stopping the government from acting against someone for what they said.
