The former police officer claims she mistakenly walked into Botham Jean’s apartment in 2018, thinking it was hers, and shot the unarmed man dead.

It is very hard to understand how
she went to the wrong apartment until you look at the psychological studies on
exhaustion. She was sleep deprived and had worked a 14 plus hour day. These
things affect our senses. Everyone has experienced memory and sensory problems
from tiredness but most of us are lucky enough to have not faced the
circumstances she did. Remember there were 46 people from her apartment complex
that admitted to going to the wrong apartment at least once. One of them was an
attorney who admitted going to the wrong apartment 10 to 12 times and actually
entered one wrong apartment and didn't realize it until he rounded a corner and
saw a woman sitting on a couch. As a retired trooper I have investigated
hundreds of crashes where people have said, I never saw the car, or truck,
coming. How big is a car or truck, in broad daylight, compared to furniture or
a person, in dim light, as is the case in this tragic incident. Sadly it
happens every day. Also sadly, this judge robbed Officer Guyger of this defense
by not allowing 3 different court recognized expert witnesses to testify in the
full scope of their experience and training. They had nearly 76 years experience
between them! This alone should have triggered a mistrial. By the way, these
three experts, one was the lead investigator and a Texas Ranger, all believed
that Officer Guyger was not guilty of a criminal offense under the
circumstances. The ranger is African American by the way. As to the actual
shooting here is my take… She pushed the door open by the pressure of pushing
the key into the lock. Remember the door wasn't latched. Mr. Jean probably
heard the gear she was carrying, her hard plastic lunch bucket probably even
bumping the door, as well as the key being pushed into the lock. Hearing these
noises he probably stood and started toward the bat he kept by the rear door.
This would account for Guygers testimony of him moving back and forth in the
back of the apartment, ie., him going toward the bat and then towards her. If
this is the case he obviously did not pick up the bat but started toward the
front door. Whether or not he started from the back of the room or from the
couch, as the prosecution argues, there is not doubt that he did start toward
the front door thus reinforcing Officer Guygers perception of a threat.
Officer Guyger says she heard movement which coincides with Jean moving about.
Guyger says she drew her sidearm and commanded him to show her his hands. This
is reflex to an Officer so I have no doubt she did command him to show his
hands. Mr. Jean was coming toward her yelling hey, hey, hey. When an officer
faces a perceived threat they usually go into a state called tunnel vision where
they are hyper focused on the threat, in this case Mr. Jean. During tunnel
vision one experiences little or no peripheral vision, ie., no furniture, no
wall decorations etc., you see only the perceived threat and nothing else!
Furthermore, he's in dim light and she is coming from a brightly lit hallway
which would affect her vision. We've all experienced that. Reverse that for Mr.
Jean, his eyes are adjusted to the dim lighting and she is standing in bright
light coming from the hallway, and she is in her police uniform. Should he have
seen her uniform and gun, which was pointed directly at him, and heard her
commands of let me see your hands, let me see your hands, and thus halted and
raised his hands? It's a reasonable question. The whole incident happened in
just a few seconds. I believe it all happened too fast for either of them to
stop their actions and reactions from colliding into tragedy.
How did she get in the apartment?
The man was sitting on the couch eating ice cream but she thought it was her apartment??. Didn't she know that the couch and furniture was not hers???

Do I think she's dumb and shouldn't be a police officer? ABSOLUTELY. Do I think police officers are human and make stupid mistakes? ABSOLUTELY. Do I think she was going home that night intending to kill an innocent man? ABSOLUTELY NOT. She will not only pay by being in jail for the rest of her life, but by reliving this in her head also. I feel for her in a way, even though I don't think I'd like her as a person if I knew her.
