As companies reopen some employers are mandating workers get the Covid-19 vaccine. NBC News’ Danny Cevallos explains if companies can legally require this.

  1. The fact that’s this is political it’s a vaccine and injected into your body basically with or with out consent, this is a dictatorship idk when ppl will wake up you lost the freedom of your body basically the only thing you have that’s yours

  3. I bet a whole bunch of you who are complaining about getting fired for not taking the vaccine were all for At-Will employment and probably thought you will never be subject to it. But then you did become a victim of At-Will and now you're all calling it tyranny. That's rich.

  4. The govt. and the media is suppressing the incredible number of serious health problems that have developed in people after being vaccinated.
    If your employer demands that you get vaccinated because it's "perfectly safe", you tell them to write up a document stating that if you suffer any effects that inhibit your ability to work, that they will be responsible for your medical and financial needs for the rest of your life. Let's see if they will agree to that!

  7. Can companies mandate the booster shot (3rd dose) also? I took a risk and got 2 doses of the vaccine. But, other people got side effects, so I don't know if I should get a 3rd dose.

If an private employer mandates a vaccine for employment, whether FDA approved or not, and should any adverse affects appear, 3, 7, 10 yrs down the road(i.e; birth defects, cancer, any type of ailment) and science proves that these affects are a direct results of the vaccine; The company can, will and should be sued.
    If you are accepting employment from a private company who requires the vaccine be taken to gain employment, and you are willing to take the vaccine; you may want to consider NOT signing the Employer Arbitration Agreement, meaning you'd be legally bond to use company approved methods to address disputes, rather than hiring your own lawyer, should an affect appear down the road.

  12. Workplace Religious Exemptions Under Title VII

    In a nutshell, Title VII requires employers to provide exemptions and accommodations for employees who raise objections to receiving employer-mandated vaccines based on their sincerely held religious beliefs.

    Sincerely Held Religious Belief

    The EEOC, which enforces Title VII, uses a very broad definition of “religion.” It goes beyond membership in a church or belief in God, and includes firmly and sincerely held moral or ethical beliefs. For instance, an employee’s objection to an employer’s policy or practice could be based on a moral belief against receiving certain chemicals in the body.

    Questioning An Employee’s Sincerely Held Religious Belief

    You should normally assume that an employee’s request for religious accommodation is based on a sincerely held religious belief. However, if you have an objective basis for questioning either the religious nature or the sincerity of a particular belief, practice, or observance, you can request additional supporting information from the employee. This is a sensitive area of the law and employers should not haphazardly question an employee or unilateral contact an employee’s place of worship. We suggest coordinating with legal counsel before taking any steps in this regard. If you have an objective basis for questioning an employee’s beliefs, the employee may substantiate their belief in a variety of forms, including written materials and the employee’s own personal explanation.

    Denying A Religious Accommodation Request Because Of Undue Hardship

    Employers must provide a reasonable accommodation if an employee’s sincerely held religious belief, practice, or observance prevents them from receiving the vaccination – unless it would pose an undue hardship under Title VII. To prove undue hardship, you must show that the proposed accommodation would cause more than a minimal cost or burden on the operations of your business.

    For instance, an accommodation may cause undue hardship if it is costly, compromises workplace safety, decreases workplace efficiency, infringes on the rights of other employees, or requires other employees to do more than their share of potentially hazardous or burdensome work. Note that this is a lower standard for an employer to meet than undue hardship under the Americans with Disabilities Act (ADA) which is defined in that statute as “significant difficulty or expense.”

    Religious Accommodation Considerations With A Mandatory COVID-19 Vaccination Program

    If you decide to mandate the COVID-19 vaccine, you will likely start to see an increase in accommodation requests based on religious beliefs, so you should begin to consider what reasonable accommodations you can offer to employees. Depending on your work environment (office setting vs. manufacturing floor), these accommodations might include continued mask wearing, social distancing, and remote working.

    Other accommodations might be isolation of an employee to a particular work area or a modification to an employee’s work schedule to reduce interaction with other employees and/or customers. Regardless of the accommodation measure chosen, you should ensure they are legitimate and non-retaliatory.

These mRNA vaccines are designated as experimental, and under the law (FDA regulations, no less) no one can be coerced to take the jab, and it is not possible to give informed consent since the CDC has not provided the results of long-term studies regarding known side-effects. Moreover, the United States is signatory to the Nuremberg Code, so unless certain persons want to be criminally prosecuted, that had better not force anyone to become a test subject.

  14. I work and live in Portland, Oregon. I lost my job yesterday bc my boss decided to make the vaccine mandatory. He wouldn’t shake my hand bc I’m vaccine hesitant. He wished me good luck with the virus and I wished him good luck with the labor shortage. I started looking for a new job today and already have 2 interviews lined up.

  17. It is really sad how many people don't know that the courts have already ruled that mandating vaccines put into use under an Emergency Use Authorization violates federal law. EUAs are used to allow the emergency use of drugs and vaccines that are not yet approved or licensed by the FDA. These drugs and vaccines are legally classed as experimental. The last time the feds tried to mandate an EUA vaccine was the Anthrax vaccine for the military. The courts ruled that it is illegal to do so. The Federal Appeals court went further in Doe vs Rumsfeld (2003), saying that trying to do so violated not only federal law, but also the basic medical ethics laws established under the Nuremberg Code in response to the Nazis forced experiments. The COVID tests were also put into use under an EUA so testing can not be mandated either. This applies to all government and private entities. Vaccines that are approved and licensed can be mandated, those in use under an EUA can not. Period.

So now that the P1ANDEM!C has effectively put millions of small businesses out of business forcing these folks to become employees, these same people who were harmed by the NIH grant funded, lab made Covid or its predecessor are forced to take an experimental vaccine in order to obtain or maintainr a job. We must have a Constitutional Convention of the States that creates a Government Accountability and Liability Amendment GALA that hold all fed. gov employees financially liable for negligence and passing or maintaining unconstitutional laws.

What they are leaving out is the fact that OSHA ruled that if an employer makes it mandatory for employees to take the shot in order to keep their employment, then that employer can be held liable for any adverse effects caused by the vaccine. It’s a slippery slope. Companies should think long and hard before making it mandatory, or they may find themselves paying out a lot in workers comp claims.
