    않은 채 마스크 미착용은 무조건 위험한 행동이라고 선동하고 있는 것이다. 게다가 사적 공간까지 공공장소 개념에 포함시켜 무차별적으로
    개인의 행동을 통제하고 있다. 여러 사람이 모이면 다 공공장소가 되는 것일까. 그렇다면 가족들이 한 집에 모이면 그것도 공공장소라는
    얘기므로 가정에서도 마스크착용을 강제할 수 있다는 것이 아닌가.

    다시 한 번 말하지만, 정부는 불특정 다수가 모이는 공공장소에서만 방역조치를 취할 수 있음을 명심해야 한다. 서로 아는 사람들이 모일 경우
    각자 서로의 전염위험성을 감수하기로 동의하고 만난 것이므로 결국은 사적공간으로 볼 수 있는바, 이처럼 개인들이 합의한 사적인 공간에는
    정부가 개입해서는 안된다. 즉, 특정인들끼리 모이는 종교집회나 각종 모임에 대해서는 어떠한 방역방침도 강제해서는 안된다는 말이다.

    한편, 방역 과정에서의 공공장소의 범위와 개념은 국민의 생계활동에 꼭 필요한 장소냐 아니냐에 따라서 결정되어야 할 것이다. 즉, 지하철,
    관공서 등은 국민이 생계활동을 하는데 꼭 필요하므로(가지 않으면 생계활동에 지장을 받으므로) 일정 부분 마스크 착용을 의무화해도 될
    것이나, 유흥이나 여가활동 목적으로 방문하는 장소는 개인이 얼마든지 여가활동을 잠시 미루거나 다른 선택을 할 수 있으므로 공공장소로
    봐서도 개입해서도 안된다. 불특정 다수가 모이는 곳이라도( 식당,헬스장 등) 생계활동에 필수적인 장소가 아니라면 사적 공간의 범주로 봐야
    한다는 말이다.

    자신이 몸이 약해서 전염위험이 크다고 생각하는 사람은 그러한 장소에 가지 않으면 되는데, 굳이 자신의 방문의 자유를 보장받기위해서
    '마스크로부터 자유로운 대신 전염위험성을 감수하겠다'고 말하는 사람들의 자유까지 제한(마스크 강제)하는 이유는 뭔가. 또, 전염위험성을
    감수하겠다고 말하는 손님들만 받겠다는 개별 자영업자들의 자유로운 결정에 대해 정부가 방역지침을 내리면서까지 그들의 영업활동의
    자유를 통제하는 이유는 무엇인가.
