GSA determines if the documents are properly stored, not the DOJ. if they are classified then they belong to the NSA, not the FBI or DOJ, so they should be involved in the case if the reporting is accurate. Trump had a standing order to declassify any documents brought to Mar-a-Lago, so if it happened on his term then they are declassified, if after then someone else leaked the documents (assuming it isn't the regular intelligence briefings ex-Presidents get). precedent set by previous Presidents, including via court cases, determine that a President has unilateral power to determine what is considered Presidential documents, allowing them to retain the documents for their own posterity projects.

    the biggest issue is that they are claiming classified documents but not looping the NSA in the case, which means that either the NSA or someone above them (Director of National Intelligence, Secretary of Defense, Undersecretary of Defense for Intelligence and Security, President) needed to have directed them officially or else the FBI seized another agency's property and would thus be infighting at the highest levels of government. it is technically a form of civil war.

17. Simply put, the DOJ may have overstepped in their grab for evidence. The third party review will be able to assert wether or not the documents really warranted the fbi raid. What the doj is doing is breaking into their opponents house and saying, “yup these are all classified and trump is bad” but won’t let anyone else make sure that they are. 20. The FBI didn’t investigate for a year and a half with full knowledge the documents were there the entire time. So how does two more months jeopardize the investigation when the delay is specifically designed to ensure what they seized fits in the scope of the warrant in the first place. 50% of the people watching believe this is more fuckery from the FBI, like burying the Hunter laptop investigation or just ignoring the fact that Hillary deleted over 30k emails AFTER they subpoenaed them. Anything that can shed legitimately on this should be embraced by the DOJ. No surprise, it isn’t
