  14. She held that gun directly in front of her, for a full eight seconds before pulling the trigger. She knew exactly what was in her hand because she could see it. Her taser is yellow and plastic. Her gun is black and metal. She's guilty as sin.

  15. Shooting Daunte was a mistake or her behalf, we can see that clearly but because intention doesn’t matter in manslaughter cases it can go one way or another. Guilty verdict returns if the jury believes her use of force was unjustified and she negligently fired her gun resulting in Daunte’s death. Acquittal if the jury find her use of force justified in that moment, even if Kim’s intention was not to shoot him with a gun maybe an reasonable officer would have. The jury has a big decision to make.

  16. In as much as this could have been a mistake, my issue here is why are US police so quick to try and use force else where in the world police would have let the driver go and apprehended him at his home or later not to resort to deadly force for a routine stop.

I think one of the keys to winning this case is to show that there could have been some other element or factor that lead Potter to mistakenly pull her gun rather than her taser other than "Human Error". That being the case, I would have done a complete medical history and physiological work up on Potter looking for any and all medical or physical factors that could account for her actions. Some of the following I would have investigated would have been:

    Did Potter have Covid?

    Give Potter and MRI – Brain cancer? Concussion? Did Potter hit her head recently no matter how slight? – Any head injury of defect could effect judgement.

    Was Potter taking any drugs or medication and if so, what….side effects from any and all drugs and medications?

    Nerve Conductor tests – Any nerve defect in the hands or arms or the brain could have resulted in Potter reaching for the wrong weapon.

    What food did Potter eat that day? Any side effects from the food she ate.

    Heart Testing – Any heart condition could have lead to the mistake.

    Any alcohol consumption?

    After looking into all the medical reasons, I would focus all the nonmedical factors like environmental. Could have cooler weather have affected tactile sense in hands resulting the mistake?

  21. This is tragic for everyone. I feel for the family of Daunte Wright. Daunte is one of many young kids in our society troubled with the law at a young age. What are the states and the local level doing to help our youth like Duante. I know parents play a big role and need to take responsibly but also have personal struggles. As a Mexican American my community struggles along with the African American community in rough neighborhoods across the country. From drugs and crime these issues impact many communities across the country. If feel for Kim Potter a 25 year veteran and Duante a trouble youth that needed.

  22. The jury will decide on two factors, neither related to the deceased: Recklessness and/or culpable negligence. The culpable negligence means that she caused "unreasonable risk" and "consciously" took a chance of causing death to Wright while using a firearm. The jury is going to have a hard time with this charge because Potter did not intend to use her firearm. However, she had not done the required daily testing of her taser and that may have left her with little knowledge of its whereabouts in the heat of stress. If you check your taser everyday you consciously become aware that it is close to your non-dominant hand. The learning becomes automatic. I doubt she ever checked her taser much. She got sloppy after all her years in the force.

  24. Does anyone know how cold it was outside that day?? It was April in Minnesota. They jury will be allowed to handle the taser and the gun. However, they will handle the items in a WARM environment, not a COLD environment like Potter was exposed to. The difference in the temperature might lead to a difference in tactile contact with a taser and gun possible resulting a misgrab.
